The wonderful folks at the ATF were nice enough to write letters to people in Montana and Tennessee. I am sure the residents of these states will appreciate their consideration.
Barret and Sabre in TN...not sure how deep their pockets are or if they could get bankrolled by a .org or something...My lawyer buddy says its hard to fight preclusion
I think we all knew this was not going to be an easy battle to win. The mammoth beast that is the federal government is not going to give up an ounce of power without a fight. Now it is time to find the right person to take this all the way to the Supreme Court and establish precedent before the makeup of the justices changes.
Just so you know, the people at the "ATF" now prefer to be called the BATFE (the Bureau of Alcohol, Tobacco, Firearms, AND Explosives). We should all make an attempt to keep in their good graces and refer to them by their proper name. (insert gagging noises here)

Well, Sotomayor is apparently anti-nunchuck, so I can't imagine her being pro-gun is she's appointed. source: http://www.huffingtonpost.com/2009/07/14/judge-sonia-sotomayor-des_n_231546.html
Bryce you are right about Sotomayor. I wrote a post about her gun beliefs the other day. She is not friendly to the 2A. But she is basically replacing someone who was not strong 2A. The key is to get this case in before one of the 5 who are strong on gun rights leaves and is replaced by Obama.

Well, this is what the proponents of the new law want - to start a fight that ends in a definitive legal test.
We're just waiting for the one rich Montana guy who can afford the legal struggle to step forward and start selling Montana guns to Montanans.
It'll be interesting, to be sure.

What we really mean to tell the ATF is that they need not exist and like the NFA should be in the ash can of history.
